WHAT INFORMATION DO WE COLLECT?

We collect personal information that you provide to us such as name, address, contact information, passwords, security data and payment information when registering at https://recosenselabs.com/ or contacting us. We also collect information and process Personal Data on behalf of our Data Controllers. We process end-user data, who are the “Data Subjects” and their rights are to be protected.The personal information we collect can include the following:
  • Name and Contact Data – We collect your first and last name, email address, postal address, phone number, and other similar contact data.
  • Credentials – We collect passwords and similar security information used for authentication and account access.
  • Payment Data – We collect your payment instrument number (such as a credit card number), and the security code associated with your payment instrument if you make purchases. We may store this information longer than 30 days in order to expedite future orders, and to automate the billing process only with your permission. All payment data is stored by our payment gateway service providers in their secured servers.
  • Information automatically collected – Some information such as IP address is collected automatically when you visit our website. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, referring URLs, country, location, information about how and when you use our website.   • Information collected from other Sources – We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources. Examples of the information we receive from other sources include: social media profile information, marketing leads and search results and links, including paid listings.
We do not onboard any data which is unnecessary or disproportionate to the needs to best serve end users with personalized experiences. We also expect our controllers to refrain from onboarding data which is unnecessary for personalization purposes.We understand the Fair Information Practice Principles and comply with the privacy laws that protect personal information. We work continuously to enhance and improve our data privacy. In order to be in line with Fair Information Practices we will take the responsive action and notify the users via in-site notification within 7 days, should a data breach occur. Our DPO will assist the Data Controllers with inquiries and occurrences of data breach.

HOW DO WE USE YOUR INFORMATION?

We process your information for purposes based on legitimate business interests in compliance with our legal obligations, and/or your consent. We use personal information collected for a variety of business purposes described below:
  • To facilitate account creation and logon process – We use the information you allowed us to collect to facilitate account creation and logon process.
  • To send you marketing and promotional communications – We may use the personal information you send to us for our marketing purposes.  You can opt-out of our marketing emails any time.
  • To send administrative information to you – We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
  • Fulfill and manage your orders – We may use your information to fulfill and manage your orders, payments, and exchanges made through the website.
  • Provide personalized experiences – We may use your information to provide better service and response to customer requests or share content and advertising tailored to your interests and/or location.

We are transparent with our customers about our processing activities. We have Data Processing Agreements with our Data Controllers to collect and process data lawfully. We keep a record of our processing activities carried out on behalf of the controller, the purpose of processing, categories involved and expected time limits.To enable our customers to be compliant with the data protection obligations under the GDPR, we sign a data processing contract that is based on standard contractual clauses. We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle also requires that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.At any time, you can request to know how your personal data is being processed, at which location, and for what purpose or stop further processing. We work with our Data Controllers to process data requests from end customers.

WILL YOUR INFORMATION BE SHARED WITH ANYONE? ​

We only share information with your consent, to comply with laws, to protect your rights, or to fulfill business obligations.
  • Compliance with Laws – We use the information you allowed us to collect to facilitate account creation and logon process.
  • Vital Interests and Legal Rights – We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
  • Other Third-Party Service Providers – We may share your data with payment gateway service providers, who process our payments. We do not share, sell, rent or trade any of your information with third parties for their promotional purposes.
  • Affiliates – We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include joint venture partners or other companies that are under common control with us.
  • Business Partners – We may share your information with our business partners to offer you certain products, services or promotions.
  • With your Consent – We may disclose your personal information for any other purpose with your consent.

DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We may use cookies and other tracking technologies to identify visitors, track website navigation and email campaign effectiveness for analytics. We only use first-party cookies on our corporate website. We, along with third-party vendors such as Google use first-party cookies (such as the Google Analytics cookies) to compile user interaction data on our product site or our partner websites.We work with our customers as a data processor in which case we do not use cookies or even require our customers to use cookies with our service.

IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

We may transfer, store, and process your information in countries other than your own. Our servers are located in Canada, Europe, and Singapore. Please be aware that your information may be transferred to, stored, and processed by us in our facilities in Canada, Europe, and Singapore. We will take all necessary measures to protect your personal information in accordance with this privacy policy and law applicable to European Economic Area. European Commission’s Standard Contractual. Such measures implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers, which require all such recipients to protect personal information that they process from the EEA in accordance with European data protection laws. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third party service providers and partners and further details can be provided upon request.

HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). The personal data and profiles of users inactive for more than 3 months will be deleted. This data will be deleted from the logs and backups after 3 months of deletion of user profiles. Our customers/partners in the EEA are expected to inform the same to their end users and get their consent before the user data is sent to RecoSense platform. When we have no ongoing legitimate business need to process your personal information, we will delete or anonymize it and isolate it from any further processing. In case of data obtained from from Data Controllers, we stop collecting personal data and delete the records within a reasonable period of time at the end of a contract or on request for deletion.

HOW DO WE KEEP YOUR INFORMATION SAFE?

We aim to protect your personal information through a system of organizational and technical security measures. Your personal information is stored in secured networks and is only accessible to employees with special access rights, who are required to keep the information confidential. In addition, all sensitive data and payment information furnished is encrypted via Secure Socket Layer (SSL) technology. All the data passed on to RecoSense platform is safe guarded with multiple layers of security listed below:
  • The data servers can only be accessed with a secure private key
  • The database requires authentication for access
  • All the data files are encrypted with a key
  • User data sent over the internet it is secured and encrypted with an SSL certificate
We also have a Data Protection Officer who is proficient at managing IT processes, data security and other critical issues associated with storing and processing of personal and sensitive data.However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our website is at your own risk. You should only access the services within a secure environment.

DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect data from or market our products/services to children under 18 years of age. By using our website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Site. As a collector, it is our customer’s responsibility to stop sending data of an end user who has requested to suppress or delete their personal data. We have updated all our products and platforms to meet the above requirements, and we now provide APIs to our customers to meet their obligations under GDPR. Our updated API documentation can be used to understand these APIs. All our customers/partners should inform end users regarding the same.
